Bring your own devices to work (BYOD) Personal devices brought to work, such as smart phones or tablets can be connected to Company WiFi. Again, streaming data, music or video of any kind is prohibited in the workplace due to licencing regulations and system efficiencies. Any personal laptop or computer brought into work must be assessed and authorised for use by a member of the IT department to limit the risk of potential harmful viruses spread through Company systems. Any personal devices authorised for work use must be updated with appropriate security and anti-virus and encryption software. If in doubt of what this entails employees should contact the IT department. Personal devices should also be up to date with suitable software such as Windows, again for specifics the IT Department will assist. Monitoring Company systems enable the use of telephone, email, voicemail, internet and other communications to be monitored. For business reasons, and in order to carry out legal obligations, use of Stokers’ systems (including the telephone and computer systems), and any personal use of them, may be continually monitored by automated software or otherwise. Monitoring is only carried out to the extent permitted or as required by law and as necessary and justifiable for business purposes. Company premises may also be monitored by CCTV equipment. The business reserves the right to retrieve the contents of email messages or check internet usage (including pages visited and searches made) as reasonably necessary in the interests of the business, including for the following purposes (this list is not exhaustive): • To monitor whether the use of the e-mail system or the internet is legitimate and in accordance with this policy; • To find lost messages or to retrieve messages lost due to computer failure; • To assist in the investigation of alleged wrongdoing; or • To comply with any legal obligation. Prohibited Activities Misuse or excessive personal use of the telephone or email systems, or inappropriate internet use, will be dealt with as a misconduct issue (under the Disciplinary Policy, in the case of employees).
Misuse of the internet can in some circumstances be a criminal offence. In particular, misuse of the email system or inappropriate use of the internet by participating in online gambling or chain letters or by creating, viewing, accessing, transmitting or downloading any of the following material will usually amount to gross misconduct in the case of employees (this list is not exhaustive): • Pornographic material (that is, writing, pictures, films and video clips of a sexually explicit or arousing nature); • Offensive, obscene, or criminal material or material which is liable to cause embarrassment to the business; • A false and defamatory statement about any person or organisation; • Material which is discriminatory, offensive, derogatory or may cause embarrassment to others (including material which breaches the Equal Opportunities Policy and/or Dignity at Work Policy); • Confidential information about Stokers, the persons that it deals with, customers, or any employees (unless authorised); • Any other statement which is likely to create any criminal or civil liability (for the employee or Stokers); and/or • Material in breach of copyright. Any such action will be treated very seriously and is likely to result in summary dismissal. Where evidence of misuse is found, Stokers may undertake a more detailed investigation involving the examination and disclosure of monitoring records to those nominated to undertake the investigation and any witnesses or managers involved. If necessary such information may be handed to the police in connection with any criminal investigation. Personal mobile devices Personal mobile phones and other devices must be stored responsibly and out of public view on Company premises. It is not permissible for employees to have such devices in use on the shop or warehouse floor, unless there is an emergency and calls are expected by the employee. It is reasonable to allow personal mobile phone usage within breaks or lunch time. Personal property is brought onto Company premises at the employees’ own risk. Stokers will not be liable for any damage to, or theft or loss of, any mobile phones or devices on its premises.
